These Terms of Service ("Terms") govern your access to and use of the Claros website and services provided by CLAWS LLC ("Claros," "we," "us," or "our"). By accessing or using our website, you agree to be bound by these Terms.
1. Services Description
Claros provides AI-powered voice receptionist services designed for aesthetic and plastic surgery practices. Our services include AI call handling, lead qualification, appointment scheduling assistance, and CRM integration.
2. Eligibility
Our services are intended for licensed healthcare practices and their authorized representatives. By using our services, you represent that you are at least 18 years old and have the authority to enter into these Terms on behalf of your practice or organization.
3. Account and Access
Certain features may require you to provide information or create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.
4. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble our technology
- Interfere with or disrupt the integrity or performance of our services
- Misrepresent your identity or affiliation with any person or entity
- Use our services to transmit harmful, threatening, or abusive content
5. Intellectual Property
All content, technology, trademarks, and intellectual property on the Claros website and within our services are owned by CLAWS LLC. You may not copy, modify, distribute, or create derivative works without our prior written consent.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
7. Payment Terms
Service fees are outlined in your individual service agreement. Subscription fees are billed monthly. All fees are non-refundable unless otherwise specified. We reserve the right to adjust pricing with 30 days' written notice.
8. Limitation of Liability
To the maximum extent permitted by law, CLAWS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind. Claros is not a medical device and does not provide medical advice.
10. Indemnification
You agree to indemnify and hold harmless CLAWS LLC from any claims, losses, or damages arising from your use of our services or violation of these Terms.
11. HIPAA Disclaimer
While Claros is designed with healthcare practices in mind, our AI voice receptionist is a lead qualification and appointment scheduling tool. Claros is not a covered entity under HIPAA. Practices are responsible for ensuring their own HIPAA compliance when integrating third-party tools.
12. Termination
Either party may terminate with 30 days' written notice. We may immediately suspend access if you violate these Terms.
13. Governing Law
These Terms are governed by the laws of the State of New Mexico, United States. Any disputes shall be resolved in the courts of New Mexico.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated at least 30 days before taking effect.
